I.General provisions
- 1.
These house rules set out the conditions for booking the apartments listed on noclegipodhawraniem.pl and the rules for using them during the stay.
- 2.
Making a booking constitutes acceptance of these house rules.
- 3.
The noclegipodhawraniem.pl website is owned by “Przedsiębiorstwo Agroturystyczne Pod Hawraniem”, Jurgów 266, 34-532 Jurgów, VAT ID (NIP) 679-10-10-155.
II.Booking an apartment
- 1.
A booking can be made:
- a.through the noclegipodhawraniem.pl website,
- b.by phone — on +48 501 472 002,
- c.by e-mail — by sending a message to: [email protected],
- d.through the booking.com, hotels.com, trivago.pl, expedia.com, nocleg.pl and similar platforms.
- 2.
After booking an apartment, the Client receives a reply in the form of a provisional booking, which sets out the payment details and the deadline for paying the deposit.
- 3.
The booking is confirmed once the deposit, in the amount agreed in advance with the property's staff, has been credited to the property's account. Failure to pay the deposit by the set deadline constitutes withdrawal from the Agreement by the Client and results in the automatic cancellation of the provisional booking.
III.Changes to a booking / cancellation of a booking
- 1.
If a booking is cancelled up to 42 days before arrival, the deposit is refunded to the Client's account.
- 2.
If the Client shortens or cancels the booking during the stay, no refund may be claimed for the unused part of the stay.
IV.Check-in
- 1.
The Client is required to inform the property's staff of the planned arrival time at the apartment no later than one day before arrival — by phone on +48 501 472 002 or by e-mail at [email protected].
- 2.
Guests may arrive at the apartments between 16:00 and 24:00.
- 3.
Check-in at other times is possible subject to prior arrangement with the property's staff and depends on the availability of the apartment concerned.
- 4.
The person handling check-in has the right to refuse to hand over the keys if the Client:
- a.does not have a valid identity document,
- b.is under the influence of alcohol or other intoxicants,
- c.behaves in an aggressive manner.
V.Check-out
- 1.
The Client must vacate the apartment by 11:00.
- 2.
Check-out after 11:00 is possible, but depends on the availability of the apartment concerned and should be arranged with the property's staff on the day before check-out.
- 3.
Staying beyond the check-out time without prior arrangement means payment for a further night, without the right to remain in the apartment.
VI.The Client's obligations and liability
- 1.
The Client is required to observe the quiet hours that apply in all apartments from 22:00 to 07:00. In the event of a reported complaint or police intervention, a member of the property's staff has the right to terminate the agreement with immediate effect, with no obligation to refund the amount due for the remaining period of the booking.
- 2.
Smoking is prohibited in all apartments. Breaching the ban on smoking cigarettes and tobacco products in an apartment constitutes consent to cover the cost of deodorising the premises, amounting to 500 zł.
- 3.
Pet policy: pets are not accepted.
- 4.
The Client bears full financial liability for any damage to or destruction of the furnishings and technical equipment in the apartment caused by the Client or by persons visiting the Client.
- 5.
The Client is required to inform the property's staff immediately of any damage or missing items found in the apartment, and to report any damage caused by the Client during the stay.
- 6.
The Client is required to secure the apartment properly: locking the entrance door and closing the windows every time the apartment is left, and keeping the keys safe, out of the reach of third parties.
- 7.
The grounds include a gazebo with a barbecue, football goals and a stream running nearby. Toys for children (including cars and prams) are also available to guests. These grounds are neither guarded nor supervised by the property's staff, and they may be used on the following terms:
- a.children may be on the grounds, in the gazebo and near the stream only under the constant supervision of a parent or guardian,
- b.the goals, sports equipment and toys must be used for their intended purpose,
- c.the barbecue must be used for its intended purpose and in accordance with fire safety rules; a lit fire must never be left unattended,
- d.after using the gazebo and the barbecue, the area must be tidied up and the fire must be checked to make sure it has been put out.
- 8.
The Pod Hawraniem property accepts no liability for damage arising from use of the gazebo, the barbecue, the goals, the toys or the area by the stream in a manner inconsistent with their intended purpose, with safety rules or with these house rules, and in particular for the consequences of leaving children unsupervised.
VII.Final provisions
- 1.
The Pod Hawraniem property is liable for damage suffered by the Client on the terms set out in the provisions of the Polish Civil Code. The property accepts no liability for damage caused solely by the fault of the Client or of persons for whom the Client is responsible, by the fault of third parties for whom the property is not responsible, or for damage resulting from force majeure.
- 2.
The property's liability for items brought in by guests is governed by the provisions of the Polish Civil Code. Please close the doors and windows carefully every time you leave the apartment, and do not leave significant sums of money or valuable items unsecured inside.
- 3.
The law applicable to the agreement and to any disputes between the property and the Client is Polish law. Disputes will be settled by the court having jurisdiction under generally applicable law. A Client who is a consumer may use out-of-court complaint and redress procedures, including the assistance of the district (municipal) consumer ombudsman or the provincial inspector of the Trade Inspection Authority.
